Terms & Conditions of Participation
Information on participation in Essential Difference’s “Valentines 2020 Giveaway” referred to as (The Promotion) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All participants are required to meet the entry criteria outlined in Terms and Conditions. The Promotion is open to those aged over 18 years and living in Australia. To participate eligible individuals must claim their promotion giveaway pack within 30days of the promotion closing time and date unless otherwise agreed upon between the recipient and promotor. The Promotion giveaway pack will not be given to a third party. Only one redemption can be made per eligible person. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s age) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promotion runs until 1pm on Friday the 14th February 2020. Information can be obtained from Essential Difference, 53A Reid Street, Wangaratta or on Essential Difference’s facebook site – https://www.facebook.com/EssentialDifference/ Participants agree that photos may be taken for promotional use at the discretion of Essential Difference for the use of promotion and must notify Essential Difference if they do not wish their photo be to be used or taken. Where personal data may be collected as part of the redemption process, the personal data will be handled strictly in accordance with current Privacy Legislation. The Promotion must be redeemed within 30 days of the promotion closing that being the 14th March 2020 unless otherwise agreed upon between the recipient and the promotor. The Promotion Giveaway Pack is void if it’s not collected or redeemed by this date. Failure to collect the Promotion Giveaway Pack forfeits the Promotion Giveaway Pack and the promoter or its associated agencies take no responsibility for loss, damage or unused giveaway pack. If the participant is unable to comply with The Promotion’s terms and conditions, then they forfeit the redemption. Redemptions are non-transferable and cannot be exchanged for cash or sold.
If The Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the offer.
The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter. The Draw and acceptance
Winner will be chosen at random by Essential Difference.
The winner will be drawn and announced on Essential Difference Facebook page on Friday 14th February 2020 at 1:00 pm.
Winner will be contacted via Facebook and is given 24 hours to respond and accept the prize.
Prize Claim
The winner must show that their name is on Essential Difference Facebook page winner announcement and show proof of identification which displays both image and full name.
No cash alternative to the prize will be offered. The prize is not transferable. Prize is subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
Legal Provisions
The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
